Shaunwill Information Technology Co., Ltd. (“Hers”, “we”, “us” and/or “our”) operates the website and its subdomains (the “Website”), the Hers mobile applications (the “App”) and other related services (collectively, the “Services”).
We are committed to protecting your privacy. This Privacy Policy describes how we collect, store, use and distribute information through our Services in terms. Please read this Privacy Policy carefully. By starting to use our Services, you consent to this Privacy Policy.
We care about the protection and confidentiality of your data. We therefore only process your data to the extent that:
a. It is necessary to provide the Hers services you are requesting,
b. You have given your consent to the processing, or
c. We are otherwise authorized to do so under the data protection laws.
Conversations with your Hers are not shared with any other company or service. We will never sell your personal data.
By using or accessing the services in any manner, you acknowledge that you accept the practices and policies outlined in this Privacy Policy, and you at this moment consent that we will collect, use, and share your information in the following ways.
Remember that your use of Hers’s services is at all times subject to the Terms of Service, which incorporates this Privacy Policy. Any terms we use in this Policy without defining them have the definitions given to them in Terms of Service.
1. Information we collect and process
Here we list all the types of personal information we collect and store throughout your experience with Hers. Some of this information may be shared with service providers who help us deliver your experience with Hers, each of such service is explained below.
We neither rent nor sell your information to anyone. Conversations with your Hers are not shared with any other company or service. We will never sell your personal data.
We DON’T knowingly collect or store medical information or protected health information defined as any information about health status, provision of health care, or payment for health care that is created or collected by a Covered Entity and can be linked to a specific individual.
We collect some technical information coming from your mobile device.
1.1. Information you provide
The following descriptions covers all the types of personal information that you may provide and that we collect and store as soon as you start using Hers and throughout your experience with our Services.
a. Subscription time: Used for receipt verification when subscribing. Data will not be shared.
b. Subscription period: Used for receipt verification when subscribing, and to enable or disable more functions on a period basis. Data will not be shared.
c. Subscription activation status: Used to enable or disable more functions when the subscription is successful or the subscription expires. Data will not be shared.
d. Subscription history: Used for after-sales service. Data will not be shared.
e. Read and write permission authorization status of menstrual data on Apple Health: Used to enable or disable reading menstrual data from Apple Health and writing menstrual data to Apple Health. Data will not be shared.
f. Menstrual data on Apple Health: Used to synchronize menstrual data on Hers and Apple Health. Data will not be shared.
g. Data on Hers which will be prepared to back up to iCloud: Used to back up Hers data to iCloud. Data will not be shared.
All items are optional. Unsubscribed users do not need to provide relevant information; Subscribed users can choose whether to provide relevant information for the enabled functions.
1.2. Device information
As described below, we collect certain information from and about the phones that you access the Services from. None of this information may identify you personally. We may also disclose aggregated user statistics in order to describe our services to current and prospective business partners, and to other third parties for other lawful purposes.
a. Device model: used for subscription receipt verification.
b. System version: used to determine function availability.
1.3. Website: Android waitlist
This section applies only to our website, not to the Hers app.
a. Email address: If you choose to leave your email address on our website to be notified when an Android version becomes available, we store it for that single purpose. We will email you once — when Android is ready. We will not use your address for marketing, newsletters, or anything else. It will not be shared or sold.
b. A one-way hash of your IP address: stored only to limit how often the same visitor can submit the form, as a protection against automated abuse. Your actual IP address is not stored, and the hash cannot be used to identify you.
c. Your browser's user agent string: stored only to confirm that submissions come from Android devices. It does not identify you personally.
This information is stored on Cloudflare's infrastructure, separately from any app data, and is deleted once the Android launch notification has been sent. You can ask us to delete it at any time by emailing dolly@shaunwill.net.
2. How we secure and protect your information
We adopt a technical architecture that minimizes storage, and use a variety of industry-standard security technologies and procedures to help protect your data from unauthorized access, use, or disclosure.
a. Except for the device technical information necessary to verify the receipt when you activate the subscription service and the subscription record after the subscription is successful, we do not set up an independent server to store any of your personal data, but store all your personal data in the persistent storage of your own phone, or after your subscription is successful, you are authorized to back up the data to your own iCloud.
b. While we use reasonable commercial efforts to protect the data, no technology, data transmission or system can be guaranteed to be 100% secure. In the event of a breach of security leading to the accidental or unlawful destruction, loss, alteration, unauthorized disclosure of, or access to your data, we will notify you as soon as we spot the issue.
3. Where we store your data
Our subscription services (including subscription service purchase receipts and subscription history records) are operated by a U.S. company, and product technical services are operated in China. If you are located in another jurisdiction, please be aware that the information about subscription you provide to us may be transferred to, stored and processed in the United States. By using our services about subscription or providing us with any information, you consent to this transfer, processing, and storage of your information in the United States, a jurisdiction in which the privacy laws may not be as same as those in the country where you reside or are a citizen. We will take all steps reasonably necessary to ensure that your data is treated securely and in accordance with this Privacy Policy.
4. Data retention
We will only retain your personal information about subscription for as long as necessary to fulfill the purposes we collected it for, including for the purposes of satisfying any legal, accounting, or reporting requirements.
To determine the appropriate retention period for personal information about subscription, we consider the amount, nature, and sensitivity of the personal information, the potential risk of harm from unauthorized use or disclosure of your personal information, the purposes for which we process your personal information and whether we can achieve those purposes through other means, and the applicable legal requirements.
5. Your data protection rights
As a Hers user, you have the following data protection rights, depending on the circumstances of the specific case:
Disclosure
To receive information about your personal subscription data processed by us. This includes information on the purpose of use, the category of data used, its recipients and authorized persons.
Correction, deletion or limitation of processing
To request the correction, deletion or limitation of the processing of your personal subscription data, e.g. by sending us an email. If (i) the subscription data are incomplete or incorrect, (ii) they are no longer necessary for the purposes for which they were collected, (iii) the consent on which the processing was based has been revoked, or (iv) you have successfully exercised your right to object to subscription data processing; in cases where data is processed by third parties, we will forward your requests for correction, deletion or limitation of the processing to these third parties, unless this proves impossible or involves a disproportionate effort.
Opposition to the processing
To object to the processing for reasons arising from your particular situation.
Refusal and revocation of consent
To refuse your consent or – without affecting the legality of subscription data processing prior to the revocation – to revoke your consent to the processing of your personal subscription data at any time.
Automatic decisions
To require that you be subject to a decision based exclusively on automated processing only in the exceptional cases provided by law, if that decision has legal effect against you or significantly affects you in a similar manner; should such an automated decision take place in exceptional cases, you have the right to obtain information on the logic involved and the scope of the intended effects.
Right of appeal
Communicate with and, if necessary, complain to the data protection supervisory authority.
6. How to delete your data
You can delete all your data(except subscription data) by deleting your account in the App. To delete your account, click “Settings”, select “Delete Account”, and follow the instructions.
7. Changes to Privacy Policy
The Services and our business may change from time to time. As a result, at times it may be necessary for us to make changes to this Privacy Policy. We reserve the right to update or modify this Privacy Policy at any time and from time to time without prior notice. We encourage you to periodically review this page for the latest information on our privacy practices. This Privacy Policy was last updated on the date indicated above. Your continued use of the Services after any changes or revisions to this Privacy Policy shall indicate your agreement with the terms of such revised Privacy Policy.
